Court Asks INEC To Resume Dino Melaye’s Recall Process

Senator Dino Melaye’s attempt to prevent recall proceedings against him by INEC has met with a setback, as his suit challenging his recall process has been dismissed by a Federal High Court in Abuja.

Justice Nnamdi Dimgba who gave the ruling on Monday said the Independent National Electoral Commission “shall proceed with the recall process”.

In giving his ruling, the judge further said that contrary to the arguments put forward by Dino Melaye that he was not given fair hearing, the constitution does not require a special provision that mandates INEC to grant the senator an opportunity of fair hearing.

The courth also asked that INEC should make available to Dino Melaye the recall petition, schedule of signatures attached to the petitions and a full list of persons in support of the recall process, within two weeks before an amended time table for the recall would be made.
